DELIVERY TO G.T.A TRUCK DOCKS - $16.50 Delivery Charge on orders less than $395.00 NET
OUT OF TOWN - $8.00 Handling Charge on orders Less than $395.00 before taxes.
MINIMUM ORDER - $6.00 Small Order Charge Applied to all orders less than $175.00 before taxes.
CONTINGENCIES - Seller shall not be liable for failure to supply the goods in consequence of labour, procurement or distribution difficulties, acts of God, fortuitous events or other causes of a like or unlike nature reasonably beyond its control, during the period of and to the extent of such disability. Deliveries omitted during such period may be eliminated from this contrast at seller's option without liability on its part.
PRICES - Prices and charges shown are those presently in effect for the destination noted, but are subject to change without notice at any time prior to transfer of title in goods. Unless otherwise noted, the customer shall pay freight to destination. The amount of any taxes, duties and other charges payable shall be charged to the customer. The cost of steel cutting dies, rubber printing dies and machine charges will be charged to the customer.
PAYMENT - Invoices shall be paid within the terms awarded to customers. Seller nevertheless reserves the right at any time to require security satisfactory to seller for the performance of buyer's obligations, to suspend the manufacture, delivery or shipment of all or any part of the goods until such security is given, and to require payment against delivery.
CLAIMS - Claims shall be restricted to the price of defective goods as shown on seller's invoice, calculated pro rata where invoice includes other goods. No claim shall be valid nor enforceable unless it is made in writing within fourteen (14) days after receipt of goods at destination. Warranty as to suitability of goods for any particular purpose or conditions is expressly excluded. Buyer shall have no claim for consequential damages.
TITLE - Title in goods and risk of their loss shall pass to buyer upon their delivery to truck, trailer or other means of transportation at seller's plant.
SHIPMENTS - Shipments shall be routed by seller. Sipping dates are given in good faith, but are not guaranteed, and buyer shall have no claim for damages resulting from delay.
OVER-RUN, UNDER-RUN, SPOILAGE - Delivery of the quantity specified in any order subject to plus 10% over-run or less 10% under-run shall constitute delivery in accordance with the order, and such over-run or under-run shall be charged or credited pro rata, as the case may be. Seller shall be allowed 1% spoilage on the quantity delivered.
MARKING - Seller reserves the right to affix its imprint to all goods.
ERRORS AND OMISSIONS - All quotations, acknowledgements and invoices are subject to correction for any errors and omissions.
AMENDMENT - These Terms and Conditions shall not be amended nor altered except by writing signed by one of seller's executive officers.
CONFLICT - If any of the terms of buyer's offer to purchase as set out in its purchase order are in conflict with these Terms and Conditions, the latter shall govern unless buyer's terms are expressly accepted in writing by seller. Buyer's purchase order shall constitute an acceptance of these Terms and Conditions.
RETURN OF MERCHANDISE (STOCK PRODUCTS ONLY) - No claims allowed unless made within fourteen (14) days of receipt of merchandise. No merchandise may be returned without permission. All returned merchandise will be subject to 10% restocking charge, when no fault exists on the part of the Seller.
PRIVACY - Seller is committed to keeping buyer's privacy. All information is stored on sellers premises, data is stored in controlled servers with limited access. Seller may send your business information to other companies or people under any of the following circumstances; when we have your consent to share the information; we need to share your information to provide a product or service you have requested; or to collect or enforce payments of amounts owing. We are an active member to Equifax .
